First introduced to Congress in 1923, The Equal Rights Amendment (ERA) was designed to guarantee a person\u2019s constitutional rights could not be denied based on their <strong>sex<\/strong>, <em>anatomical variances between males and females<\/em>. Even though the <a href=\"https:\/\/www.npr.org\/2022\/03\/22\/1086978928\/50-years-ago-sex-equality-seemed-destined-for-the-constitution-what-happened\">ERA has not officially been ratified,<\/a> let\u2019s consider sex and gender from a sociological perspective.<\/p>\n<p>It is important to understand that sex and gender are not synonymous. Sex is biological. The term <strong>intersex<\/strong> also refers to a biological condition in which <em>a person is born with a combination of male and female sexual organs<\/em>. On the other hand, <strong>gender<\/strong> <em>is the socially learned expectations and behaviors associated with being male or female<\/em>. When the ERA was introduced, American society had very strict <strong>gender roles<\/strong> in terms of <em>the public expression of one\u2019s gender<\/em>, and <strong>gender norms<\/strong>, <em>behaviors or traits that society attributes to a particular sex. <\/em>With that in mind, variations in <em>an individual\u2019s inner sense and identification of being a male or female<\/em> or <strong>gender identity<\/strong> have <a href=\"https:\/\/theconversation.com\/lgbt-history-month-forgotten-figures-who-challenged-gender-expression-and-identity-centuries-ago-153815\">always existed, even if not acknowledged by the larger society<\/a>.<\/p>\n<p><img decoding=\"async\" class=\"alignright wp-image-110126 size-medium\" src=\"http:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2022\/03\/pexels-oriel-frankie-ashcroft-3247631-6054373-300x200.jpg\" alt=\"A group of people with a sign that says &quot;Trans rights now.&quot;\" width=\"300\" height=\"200\" srcset=\"https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2022\/03\/pexels-oriel-frankie-ashcroft-3247631-6054373-300x200.jpg 300w, https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2022\/03\/pexels-oriel-frankie-ashcroft-3247631-6054373-1024x683.jpg 1024w, https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2022\/03\/pexels-oriel-frankie-ashcroft-3247631-6054373-768x512.jpg 768w, https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2022\/03\/pexels-oriel-frankie-ashcroft-3247631-6054373-1536x1024.jpg 1536w, https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2022\/03\/pexels-oriel-frankie-ashcroft-3247631-6054373-2048x1366.jpg 2048w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p><em>A person who identifies with a gender that is different from his or her biological sex<\/em> is considered <strong>transgender<\/strong>. The <em>process of having surgery and taking hormone medications to become the opposite sex<\/em> is <strong>sex reassignment<\/strong>. As of late, <a href=\"https:\/\/www.texastribune.org\/2022\/03\/21\/texas-transgender-investigation-child-abuse-appeals-court\/\">Texas has become the hotbed for issues of gender because the state legislature tried to label parents who support their transgender children as child abusers<\/a>.<\/p>\n<p>The topic of equal rights often segues to equal pay. Looking at the numbers, one finds that economic equality between the sexes has still not been achieved. On average, a <a href=\"https:\/\/www.census.gov\/library\/stories\/2022\/01\/gender-pay-gap-widens-as-women-age.html#:~:text=Although%20the%20gender%20pay%20gap,the%20Bureau%20of%20Labor%20Statistics.\">woman earns 82 cents for every dollar a man earns<\/a>. When <em>the overlap of personal and social identities that manifests as disadvantage and discrimination in people\u2019s lives<\/em> or <strong>intersectionality<\/strong> is applied, the pay gap is nothing short of disheartening. A <a href=\"https:\/\/www.americanprogress.org\/article\/women-of-color-and-the-wage-gap\/\">Black woman earns, on average, 64 cents for every dollar a White man earns, and a Hispanic woman earns 57 cents<\/a>. Even in instances when women and men are literally doing the same job, the wage gap persists. Case in point, the U.S. Women\u2019s Soccer team. For years, their record far surpassed that of the men\u2019s team in terms of international wins, yet they were paid substantially less. Specifically, women were paid <a href=\"https:\/\/www.statista.com\/chart\/4573\/the-us-national-soccer-teams-gender-pay-gap\/\">$3,600 per game, with a $1,350 bonus for winning. Men were paid $5,000 and an additional $8,166 respectively<\/a>. For a World Cup first-place win, the women players got an extra $75,000, while the men players got an additional $390,625. This is literally for playing the same sport, on the same size field, with the same rules. Least you think it was simply an audience or viewership issue and that more people watch men\u2019s soccer, the women\u2019s team actually has <a href=\"https:\/\/www.statista.com\/chart\/4573\/the-us-national-soccer-teams-gender-pay-gap\/\">the record for the most viewers of any U.S. soccer game<\/a>. These inequalities are evidence of the <strong>glass ceiling<\/strong>, <em>social and legal barriers designed to prevent minorities and women from advancing in the workplace<\/em>. In fact, <a href=\"https:\/\/www.census.gov\/newsroom\/stories\/equal-pay-day.html\">March 15, 2022, marked Equal Pay Day in the United States<\/a>. Equal Pay Day represents how far into the year a woman must work to begin to earn the money a man earned the previous year. In the United States, <a href=\"https:\/\/www.aclu.org\/blog\/womens-rights\/womens-rights-workplace\/equal-pay-act-youve-come-long-way-baby-not-all-way\">the Equal Pay Act of 1963<\/a> did lessen the pay disparity between men and women for doing the same job, but years of court challenges have weakened the legislation.<\/p>\n<p>From a sociological perspective, the inequality women experience is <strong>gender stratification<\/strong>, <em>the unequal access and distribution of wealth, power, and privilege between women and men<\/em>.
