At the time<\/span><span style=\"font-size: 16px;\" data-contrast=\"auto\">,<\/span><span style=\"font-size: 16px;\" data-contrast=\"auto\"> a <\/span><b style=\"font-style: inherit;\"><span data-contrast=\"auto\">crime, <\/span><\/b><i style=\"font-weight: inherit;\"><span data-contrast=\"auto\">an offense in violation of public law, <\/span><\/i><span style=\"font-size: 16px;\" data-contrast=\"auto\">punishable by death ranged anywhere from theft and <\/span><b style=\"font-style: inherit;\"><span data-contrast=\"auto\">counterfeiting<\/span><\/b><span style=\"font-size: 16px;\" data-contrast=\"auto\">, <\/span><i style=\"font-weight: inherit;\"><span data-contrast=\"auto\">the manufacturing and selling of illegally copied products,<\/span><\/i><span style=\"font-size: 16px;\" data-contrast=\"auto\"> to violent offenses like murder and rape<\/span><span style=\"font-size: 16px;\" data-contrast=\"auto\">,<\/span><span style=\"font-size: 16px;\" data-contrast=\"auto\"> and the <\/span><a style=\"font-size: 16px; background-color: #ffffff;\" href=\"https:\/\/nlb.overdrive.com\/media\/1263525\"><span data-contrast=\"none\">preferred method of execution<\/span><\/a><span style=\"font-size: 16px;\" data-contrast=\"auto\"> was hanging. An important point for consideration, particularly given the opportunity to look back at a different time, is the question of <\/span><b style=\"font-style: inherit;\"><span data-contrast=\"auto\">collective conscience<\/span><\/b><span style=\"font-size: 16px;\" data-contrast=\"auto\">, <\/span><i style=\"font-weight: inherit;\"><span data-contrast=\"auto\">a set of shared attitudes, beliefs, and ideas about how things should be in society, <\/span><\/i><span style=\"font-size: 16px;\" data-contrast=\"auto\">and its capacity to change over time. <\/span><span style=\"font-size: 16px;\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">One aspect of public opinion\u2019s change over time can be seen through who is considered a criminal and for what alleged crimes (particularly ones deserving of government-facilitated execution). As observed in colonial times, persons deserving of death for their criminal activity were found guilty of a <\/span><a href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/article\/history-of-the-death-penalty\/\"><span data-contrast=\"none\">wide range of crimes<\/span><\/a><span data-contrast=\"auto\"> \u2014 some as surprising as adultery and idolatry. Although these <\/span><a href=\"https:\/\/deathpenaltyinfo.org\/curriculum\/high-school\/about-the-death-penalty\/history-of-the-death-penalty\"><span data-contrast=\"none\">capital offenses were narrowed<\/span><\/a><span data-contrast=\"auto\"> by some states throughout the 1800s, with treason as the only worthy crime in Michigan and the complete abolition of the death penalty in Wisconsin and Rhode Island, this same effect did not extend to all spaces in the U.S. Southern states took a quick lead at this point in number of executions, many of those <\/span><a href=\"https:\/\/www.americanbar.org\/groups\/crsj\/publications\/human_rights_magazine_home\/2016-17-vol-42\/vol-42-no-2-the-death-penalty-how-far-have-we-come\/the-racial-origins-of-the-supreme-courts-death-penalty-oversight\/\"><span data-contrast=\"none\">executions relevant within the context of slavery<\/span><\/a><span data-contrast=\"auto\">. The state of Virginia, for example, <\/span><a href=\"https:\/\/www.americanbar.org\/groups\/crsj\/publications\/human_rights_magazine_home\/2016-17-vol-42\/vol-42-no-2-the-death-penalty-how-far-have-we-come\/the-racial-origins-of-the-supreme-courts-death-penalty-oversight\/\"><span data-contrast=\"none\">considered 66 crimes worthy<\/span><\/a><span data-contrast=\"auto\"> of the death penalty when committed by an enslaved person \u2014 a poignant example of <\/span><b><span data-contrast=\"auto\">differential justice<\/span><\/b><span data-contrast=\"auto\">, <\/span><i><span data-contrast=\"auto\">a set of shared attitudes, beliefs, and ideas about how things should be in society<\/span><\/i><span data-contrast=\"auto\">. The motivation to find enslaved Africans guilty of capital offenses came from desires to financially profit off of state compensation from executions and to demonstrate consequences for liberation attempts and resistance. Today, in the <\/span><a href=\"https:\/\/www.justice.gov\/usao\/justice-101\/sentencing#:~:text=The%20death%20penalty%20can%20only,to%20impose%20the%20death%20penalty\"><span data-contrast=\"none\">federal criminal process<\/span><\/a><span data-contrast=\"auto\">, crimes punishable by death are treason, murder, kidnapping of certain government officials, and genocide.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\"><img decoding=\"async\" class=\"alignright wp-image-110212 size-medium\" src=\"http:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2024\/10\/San_Quentin_Gas_Chamber-300x200.jpg\" alt=\"A San Quentin gas chamber.\" width=\"300\" height=\"200\" srcset=\"https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2024\/10\/San_Quentin_Gas_Chamber-300x200.jpg 300w, https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2024\/10\/San_Quentin_Gas_Chamber-768x512.jpg 768w, https:\/\/uitac.com\/inthenewsblog\/wp-content\/uploads\/sites\/8\/2024\/10\/San_Quentin_Gas_Chamber.jpg 780w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>The question of death-eligible crimes and populations aside, what is an appropriate manner of conducting executions? The first executions in the U.S. were primarily completed by means of hanging. <\/span><a href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/article\/history-of-the-death-penalty\/\"><span data-contrast=\"none\">British influence<\/span><\/a><span data-contrast=\"auto\"> extended to the colonies with the implementation of historic methods of execution<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\"> such as crushing to death and boiling. These methods likely come across as barbaric and extremely cruel to the 21st-century observer, though they were believed to be appropriate to some degree at the time they were implemented. Some <\/span><a href=\"https:\/\/deathpenaltyinfo.org\/executions\/methods-of-execution\/description-of-each-method\"><span data-contrast=\"none\">modern methods of execution<\/span><\/a><span data-contrast=\"auto\"> include lethal injection, electrocution, gas chambers, and firing squads. Currently, all of these methods are <\/span><a href=\"https:\/\/deathpenaltyinfo.org\/executions\/methods-of-execution\"><span data-contrast=\"none\">legal in at least some states<\/span><\/a><span data-contrast=\"auto\">. There is, of course, variability in methodology between states, with a <\/span><a href=\"https:\/\/deathpenaltyinfo.org\/executions\/methods-of-execution\/description-of-each-method\"><span data-contrast=\"none\">federal court in California<\/span><\/a><span data-contrast=\"auto\"> declaring lethal gas as cruel and unusual punishment. <\/span><a href=\"http:\/\/defined%20by%20the%20united%20states%20supreme%20court\/\"><span data-contrast=\"none\">Defined by the United States Supreme Court<\/span><\/a><span data-contrast=\"auto\">, cruel and unusual punishment is loosely defined as the \u201cunnecessary and wanton infliction of pain\u201d and has often been interpreted inconsistently.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A current case for cogitation on the methodology of the death penalty revolves around the recent <\/span><a href=\"https:\/\/www.nytimes.com\/2024\/01\/25\/us\/execution-alabama-kenneth-smith.html\"><span data-contrast=\"none\">execution of Kenneth Eugene Smith<\/span><\/a><span data-contrast=\"auto\">. Smith was convicted in 1996 of the murder of Elizabeth <\/span><span data-contrast=\"auto\">D<\/span><span data-contrast=\"auto\">orlene Sennett, as recruited by Sennett\u2019s husband. On January 25th, 2024<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\"> Smith became the first individual in the U.S. to face execution by means of nitrogen gas. Smith\u2019s execution was cleared to begin at 7:56<\/span> <span data-contrast=\"auto\">pm<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\"> and he was pronounced dead at 8:25<\/span> <span data-contrast=\"auto\">pm. <\/span><a href=\"https:\/\/www.pbs.org\/newshour\/nation\/an-eyewitness-account-of-what-happened-at-the-nations-1st-nitrogen-gas-execution#:~:text=ATMORE%2C%20Ala.,first%20execution%20using%20nitrogen%20gas\"><span data-contrast=\"none\">Eyewitness accounts<\/span><\/a><span data-contrast=\"auto\"> of the execution cite Smith as having experienced seizure-like symptoms for a large portion of those 29 minutes. Following the execution, the murder victim\u2019s son, Mike Sennett, was <\/span><a href=\"https:\/\/apnews.com\/article\/nitrogen-execution-death-penalty-alabama-699896815486f019f804a8afb7032900\"><span data-contrast=\"none\">quoted as saying<\/span><\/a><span data-contrast=\"auto\">, \u201cWe are not going to be jumping around, whooping and holler, hooray and all that . . . The extent to which this system is reflective of society\u2019s collective conscience is a worthy point of consideration.
